Online Mediation – The Future of Family Dispute Resolution

The rise of online and video mediation means families can now access dispute resolution from anywhere

This innovation, which became firmly established post-pandemic, is now embedded in court rules as an accepted first step before legal action.

Online family mediation meetings are structured sessions conducted over video call or other digital platforms where a trained mediator helps families resolve disputes commonly related to separation, divorce, child arrangements, or finances, without the need to meet in person.

Key features include:

  • Convenience and Flexibility: Meetings can take place from any location that feels comfortable and safe, reducing stress and making it easier to fit sessions into busy schedules.
  • Platforms Used: Common tools are Teams, Zoom and WhatsApp video. Most services use Zoom for its stability and features like breakout rooms.
  • Process Overview:

    • The first meeting is an individual private session called a MIAM (Mediation Information and Assessment Meeting), where the process and options are      explained.
    •
    • Subsequent sessions can involve both parties together or separately (shuttle mediation), with the mediator guiding discussions towards agreement.
    •
    • Agreements reached can be provided in written form and made legally binding if required.
  • Confidentiality and Control: Mediators control the meeting (can mute participants, manage who is present, prevent recordings), keeping the sessions private     and respectful.
  • Suitability: Online mediation is suitable for people with location, mobility, or personal safety concerns, and those who don't want to be in the same room as the other party.
  • Benefits of online mediation:

    • Increased accessibility for families in remote areas or with time limitations.
    •
    • Maintaining privacy and reducing stress because participants can join from safe, familiar environments and no longer need to be sitting together in the same room.
    •
    • Online sessions are equally valid under the law for fulfilling mediation requirements.
    •
    • Mediation can adapt to participants’ schedules and needs, making it easier to fit around work, school runs, or other commitments.
    •
    • Online mediation is a very cost-effective way of resolving issues.

Preparation  Tips:

  • Find a quiet, private spot for your meeting.
  •
  • Test your technology in advance (camera, microphone, internet connection).
  •
  • Review any guidance or materials sent by the mediator before the session.
  •
  • Avoid distractions and focus on the discussion
  •

If you qualify for legal aid, online family mediation may be free in the UK.

If you are going to use mediation to help you discuss issues relating to your children then you may be eligible for one of the governments £500 vouchers to help towards the costs of joint meetings.
